Court to decide if human genes can be patented

WASHINGTON (AP) ? The Supreme Court announced Friday it will decide whether companies can patent human genes, a decision that could reshape medical research in the United States and the fight against diseases like breast and ovarian cancer.

The justices' decision will likely resolve an ongoing battle between scientists who believe that genes carrying the secrets of life should not be exploited for commercial gain and companies that argue that a patent is a reward for years of expensive research that moves science forward.

The current case involves Myriad Genetics Inc. of Salt Lake City, which has patents on two genes linked to increased risk of breast and ovarian cancer. Myriad's BRACAnalysis test looks for mutations on the breast cancer predisposition gene, or BRCA. Those mutations are associated with much greater risks of breast and ovarian cancer.

But the American Civil Liberties Union challenged those patents, arguing that genes couldn't be patented, and in March 2010, a New York district court agreed. But the U.S. Court of Appeals for the Federal Circuit has now twice ruled that genes can be patented, in Myriad's case because the isolated DNA has a "markedly different chemical structure" from DNA within the body.

Among the ACLU's plaintiffs are geneticists who said they were not able to continue their work because of Myriad's patents, as well as breast cancer and women's health groups, patients and groups of researchers, pathologists and laboratory professionals. "It's wrong to think that something as naturally occurring as DNA can be patented by a single company that limits scientific research and the free exchange of ideas," said Chris Hansen, staff attorney with the ACLU Speech, Privacy and Technology Project.

A call to a Myriad spokeswoman was not immediately returned, but in court papers the company's lawyers said without being able to patent and profit from their work, they would not be able to fund the type of medical breakthroughs doctors depend on. The company also said that deciding now that genes can't be patented would throw into chaos current research and profits structures for drug-makers and medical research companies, who have gotten more than 40,000 DNA-related patents from the Patent and Trademark Office for almost 30 years, according to court papers.

"Moving the goalposts of patent eligibility for these patents now would ... undermine the interests of the investing community: Clear and certain patent protection is critical to honor the interests of past investors, such as those who funded the research behind these inventions," the company said in court papers.

In 2010, a federal judge ruled that genes cannot be patented. U.S. District Judge Robert Sweet said he invalidated the patents because DNA's existence in an isolated form does not alter the fundamental quality of DNA as it exists in the body or the information it encodes. But the federal appeals court reversed him in 2011, saying Myriad's genes can be patented because the isolated DNA has a "markedly different chemical structure" from DNA within the body.

The Supreme Court threw out that decision and sent the case back to the lower courts for rehearing. This came after the high court unanimously threw out patents on a Prometheus Laboratories, Inc., test that could help doctors set drug doses for autoimmune diseases like Crohn's disease, saying the laws of nature are unpatentable.

But the federal circuit upheld Myriad's patents again in August, leading to the current review. The court likely will hear the case in the early spring and rule before the end of the summer.

Property taxes, fees to rise in 2013-2014 - Mercer Island Reporter

The Mercer Island City Council approved a series of tax and fee increases to balance the city?s biennial general fund budget for 2013 and 2014, at its regular Nov. 19 public meeting at City Hall.

The Council voted to approve various tax and fee changes for the next two years. Those changes mean increased property and utility taxes for Island homeowners and fee changes for some city services related to building permits and related services. The amount of money expected to be generated by the increases will balance the city budget.

Just one person came to comment on the upcoming tax increases. Islander Carv Zwingle reminded the Council that many Islanders are living on fixed incomes.

?These incremental tax increases may not mean a lot to you, but they do to us,? Zwingle said.

Prior to the vote on Nov. 19, the City Council went over the draft budget in prior meetings. The review brought more cost savings through cuts and deferred spending on new projects or upgrades to ease the burden on tax payers.

As a result, the City Council deferred or eliminated $3.6 million of capital expenditures that included the First Hill drainage system extension, water system improvements and the East Mercer Way sewer replacement project. City staff also pulled out $148,000 by delaying replacements to the city?s fleet, technology upgrades and more.

The Council approved a series of ordinances to institute the various fees and tax increases, including: a property tax increase of 1 percent; a new uniform tax rate on water, sewer and storm water utilities of 3.9 percent; rate increases for both city- and county-furnished services; permit fee increases; and an increase to the city?s ambulance transport fee.

The figures in the table represent the impact of these tax changes on an Island homeowner with a home with an average assessed value of $700,000.

Property taxes will increase by just under $70? for the average homeowner next year and an additional 7 percent, or about $10 more, in 2014.

Besides the newly approved taxes for the fire station and rescue truck, the 1 percent increases are a direct effect of lower tax revenues and higher costs, Corder said.

City financial planners had grappled with lower real estate excise taxes revenues than they expected this year, particularly from the sales of higher-end homes.

Up until August, no homes had sold for greater than $5 million this year, leaving the city worried for future years. The number of sales did pick up, however, in the late summer, with one home per month selling at $5 million or more since August.

Eyeing this trend, the city and the Council have been actively looking at ways to reduce expenses for some time. According to the city finance director, Chip Corder, the aim was to make up any shortfall with 50 percent new revenue sources and 50 percent from reducing costs.

?It ended up that we reduced expenses further than the 50 percent we planned for,? he said.

?We have already cut $4 million over the past four and a half years,? he added.

Largest whale's acrobatic ambush

Blue whales perform underwater acrobatics to attack their prey from below, scientists have found.

The massive mammals are known for lunge-feeding; gulping up to 100 tonnes of krill-filled water in less than 10 seconds.

Using suction cup tags, US researchers have recorded the surprising manoeuvrability of the giants.

They found that the whales roll 360 degrees in order to orientate themselves for a surprise attack.

The results are published in the Royal Society journal Biology Letters by Dr Jeremy Goldbogen and colleagues for the Cascadia Research Collective based in Washington, US.

"Despite being the largest animals to have ever lived, blue whales still show an impressive capacity to perform complex manoeuvres that are required to efficiently exploit patches of krill," said Dr Goldbogen.

Blue whales feed exclusively on krill: small crustaceans that have excellent escape responses, requiring the mammals to have efficient foraging strategies to be able to meet their energy demands.

To understand how these giants manage to capture prey, despite their size reducing their mobility, Dr Goldbogen and his team tagged a group of animals off the coast of southern California, US.

Using suction cups to safely attach the acoustic recording tags without harming the animals, the team were able to track the whales' movements with the help of underwater microphones.

Results revealed that the whales were executing impressive spins below the waves in order to access large patches of krill.

Tubular turns

"As the blue whale approaches the krill patch, the whale uses its flippers and flukes to spin 180 degrees so that the body and jaws are just beneath the krill patch," explained Dr Goldbogen.

"At about 180 degrees, the mouth just begins to open so that the blue whale can engulf the krill patch from below.

As the blue whale engulfs the prey-laden water, it continues to roll in the same direction and completes a full 360 roll and becomes horizontal again ready to target and attack the next krill patch."

The researchers were able to record video footage of the impressive acrobatics using a video camera worn by another animal to capture natural behaviour.

"We did not expect to see these types of manoeuvres in blue whales and it was truly extraordinary to discover," said Mr Goldbogen.

Previous research has identified similar behaviour in other rorqual whale species such as humpback whales, but these animals rarely exceed 150 degree turns.

In these smaller whale species the ability to twist and turn was attributed to long fins and tail flukes.

For blue whales however, scientists suggest the extra effort of turning rewards the massive mammals with enormous meals.

They also propose that the acrobatics optimise the animals' field of view.

"As in all cetaceans, [blue whales'] eyes are positioned laterally, and thus rolling the body should enhance panoramic vision in multiple dimensions," the study reported.

Dr Goldbogen commented that the results will fuel further research into the complex behaviour of whales, especially regarding predator-prey interactions.

"This extraordinary ability is only a glimpse into the diverse repertoire of manoeuvring behaviours performed by foraging animals," he told BBC Nature.

"Future tagging work has the potential to reveal many more unique insights into the daily lives of animals in their natural environment."

Euro zone to seek Greek aid deal without write-off | Economy | GMA ...

BRUSSELS - Euro zone finance ministers and the International Monetary Fund began their third attempt in as many weeks to release emergency aid for Greece on Monday, with policymakers saying a write-down of Greek debt is off the table for now.

?

Greek Finance Minister Yannis Stournaras voiced confidence the ministers would finally reach a deal after Greece had fulfilled its part of the deal by enacting tough austerity measures and economic reforms.

?

"I'm certain we will find a mutually beneficial solution today," he said on arrival for what was set to be another marathon meeting.

?

Greece, where the euro zone's debt crisis erupted in late 2009, is the currency area's most heavily indebted country, despite a big "haircut" this year on privately-held bonds. Its economy has shrunk by nearly 25 percent in five years.

?

EU Economic and Monetary Affairs Olli Rehn said it was vital to disburse the next 31 billion euro tranche of aid "to end the uncertainty that is still hanging over Greece". He urged all sides to "go the last centimeter because we are so close to an agreement".

?

Greece had met international lenders' conditions and "Now it is delivery time for the Eurogroup and the IMF," Rehn said.

?

Negotiations have been stalled over how Greece's debt, forecast to peak at almost 190 percent of gross domestic product next year, can be cut to a more sustainable 120 percent within 8-10 years.

?

Without agreement on how to reduce the debt, the IMF has held up payments to Athens because there is no guarantee of when the need for emergency financing will end.

?

The key question is: Can Greek debt become sustainable without the euro zone writing off some of the loans to Athens?

?

IMF Managing Director Christine Lagarde said on arrival that the solution must be "credible for Greece". The IMF argues that the debt can only be made sustainable if euro zone governments write off some of their loans to Athens, but Germany and its northern European allies have so far rejected any such idea.

?

Debt relief ?not on table??

?

Two European Central Bank policymakers, vice-president Vitor Constancio and executive board member Joerg Asmussen, said debt forgiveness was not on the agenda for now.

?

"It has been clearly stated. It is not on the table. Everything else is just rumors," Constancio told reporters in Berlin.

?

Asmussen told Germany's Bild newspaper the package of measures would include a substantial reduction of interest rates on loans to Greece and a debt buy-back by Greece, funded by loans from a euro zone rescue fund.

?

So far, the options under consideration include reducing interest on already extended bilateral loans to Greece from the current 150 basis points above financing costs.

?

How much lower is not yet decided -- France and Italy would like to reduce the rate to 30 basis points (bps), while Germany and some other countries insist on a 90 bps margin.

?

Another option, which could cut Greek debt by almost 17 percent of GDP, is to defer interest payments on loans to Greece from the EFSF, a temporary bailout fund, by 10 years.

?

The European Central Bank could forego profits on its Greek bond portfolio, bought at a deep discount, cutting the debt pile by a further 4.6 percent by 2020, a document prepared for the ministers' talks last week showed.

?

Not all euro zone central banks are willing to forego their profits, however, the German Bundesbank among them.

?

Greece could also buy back its privately-held bonds on the market at a deep discount, with gains from the operation depending on the scope and price.

?

But the preparatory document from last week said that the 120 percent target could not be reached in 2020, only two years later, unless ministers accept losses on their loans to Athens, provide additional financing or force private creditors into selling Greek debt at a discount.

?

The latest analysis for the ministers showed the debt could come down to 125 percent of GDP in 2020, one euro zone official with insight into the talks said.

?

Forgiving official loans??

?

To cut the debt more boldly, the IMF wants the euro zone to forgive Greece some of the official loans, in what is called Official Sector Involvement (OSI) in EU jargon.

?

On Monday, the biggest battle is likely to be over just that.

?

"OSI is at the core of the problems with reaching a deal," one euro zone official with insight into the talks said.

?

German central bank governor Jens Weidmann has suggested that Greece could "earn" a reduction in debt it owes to euro zone governments in a few years if it diligently implements all the agreed reforms. The European Commission backs that view.

?

An opinion poll published on Monday showed Greece's anti-bailout SYRIZA party with a four-percent lead over the Conservatives who won election in June, adding to uncertainty over the future of reforms.

?

German paper Welt am Sonntag said on Sunday that euro zone ministers were considering a write-down of official loans for Greece from 2015, but gave no sources and a euro zone official said such an option was never seriously discussed.

?

"It will be touch-and-go if we get a deal on Greece on Monday," a senior euro zone official said. "Euro zone countries have made concessions worth a lot of money already, so it is difficult to see how this can move even further."

?

French Finance Minister Pierre Moscovici said on Sunday that euro zone ministers made big progress to reach a common position during at a conference call on Saturday in preparation for their talks with the IMF on Monday.

?

"I will go with a firm determination, with a mandate from the president and prime minister, to reach a conclusion," Moscovici said. "We are very close to a solution."

?

Moscovici mentioned the reduction of interest on bilateral loans, foregoing ECB profits on Greek bonds and the debt buy-back as the options that would need to be applied for a deal as well as additional financing for Athens to keep it funded until 2016, rather than only until 2014. ? Reuters

Divers, cadaver dogs search for missing teen

Updated at 11:11 a.m. ET -- A dive team from the New Mexico State Police was resuming its search near the dam at Vallecito Reservoir on Monday for Dylan Redwine, a 13-year-old boy who disappeared from his father's home during a court-ordered visitation over Thanksgiving in southwestern Colorado.

According to The Durango Herald, the divers began the search Sunday in an area that cadaver dogs had flagged Saturday while aboard watercraft.

No remains had been found by Monday morning.

Cadaver dogs and patrols were also going out around the 12 miles of shoreline, La Plata County Sheriff?s Office spokesman Dan Bender told NBC News on Monday.

Redwine was reported missing on Nov. 19 by his father, Mark, who said he left the house in Vallecito, La Plata County, about 7:30 a.m. and returned a few hours later to find his son gone.?

Dylan was described as 5 feet tall, 105 pounds, blond hair, blue eyes with a fair complexion.?He was last seen wearing a blue and white Duke Blue Devils baseball cap, a black Nike T-shirt, black basketball shorts, black Jordan tennis shoes and a black backpack.

On Saturday, about 200 volunteers and law enforcement officials went door to door in the region and?searched hills near Vallecito Lake, the Denver Post said.

"Every time someone sees a young male child with light hair or with a black backpack we're getting calls," Bender said, adding that there had been no confirmed sightings of Dylan.


The Herald said police are also looking to speak with two boys who were seen by a postal worker on Nov. 19 at the Vallecito Lake Country Market, according to Bender.

The postal worker, who knows Dylan, said one of the boys looked like him, adding that both teens were also wearing black backpacks. As of Monday morning, Bender said police had not heard from the two boys.

According to a news release, the La Plata County Sheriff?s Office is ?working with local representatives of the FBI to share information and resources as they continue to develop leads on where Dylan may be," The Herald reported.

?Scenarios from abduction to runaway are being examined,? the release said. ?Without any new clues, we have to continue to consider any and all possibilities." The FBI has not officially taken over the investigation, Bender told NBC News.

Dylan, his mother and his brother had moved to Colorado Springs this summer, NBC station KUSA of Denver reported.

Vallecito is more than 7,000 feet above sea level in the middle of rugged terrain. The weather in the area in the past few days has been clear and cool, with highs in the 50s and lows below freezing.?

(AP) ? Deforestation in Brazil's Amazon rainforest has dropped to its lowest level in 24 years, the government said Tuesday.

Satellite imagery showed that 1,798 square miles (4,656 square kilometers) of the Amazon were deforested between August 2011 and July 2012, Environment Minister Izabella Teixeira said a news conference. That's 27 percent less than the 2,478 square miles (6,418 square kilometers) deforested a year earlier. The margin of error is 10 percentage points.

Brazil's National Institute for Space Research said the deforestation level is the lowest since it started measuring the destruction of the rainforest in 1988.

Sixty-three percent of the rainforest's 2.4 million square miles (6.1 million square kilometers) are in Brazil.

The space institute said that the latest figures show that Brazil is close to its 2020 target of reducing deforestation by 80 percent from 1990 levels. Through July 2012 deforestation dropped by 76.26 percent.

George Pinto a director of Ibama, Brazil's environmental protection agency, told reporters that better enforcement of environmental laws and improved surveillance technology are behind the drop in deforestation levels.

Pinto said that in the 12-month period a total of 2,000 square meters of illegally felled timber were seized by government agents. The impounded lumber is sold in auctions and the money obtained is invested in environmental preservation programs.

Environment Minister Teixeira said that starting next year Brazil will start using satellite monitoring technology to detect illegal logging and slash-and-burn activity and issue fines.

"Over the past several years Brazil has made a huge effort to contain deforestation and the latest figures testify to its success," said Adalberto Verissimo, a senior researcher at Imazon, an environmental watchdog agency. "The deforestation figures are extremely positive, for they point to a consistent downward trend."

"The numbers disprove the argument that deforestation is necessary for the country's economy to grow, he said by telephone from his office in the Amazon city of Belem." Deforestation has been dropping steadily for the past four years while the economy has grown," he said

"But the war is far from over. We still have a lot of battles to fight and win."

For Marcio Astrini, Greenpeace coordinator in the Amazon region, said the lower figures show that reducing deforestation is perfectly possible, but he added that "the numbers are still too high for a country that does not have to destroy one single hectare in order to develop."

BAE may close major UK shipyard: paper

LONDON (Reuters) - British defense contractor BAE Systems may close one of its major shipyards in Britain as it looks to balance capacity with future workloads, a top executive has told a newspaper in an interview published on Sunday.

Nigel Whitehead, who is group managing director, programs and support, told the Sunday Telegraph that BAE, which operates a shipyard in Portsmouth and two in Glasgow, "anticipate(s) that there will be a reduction in footprint".

"We anticipate ... that part of that might actually be the cessation of manufacturing at one of the sites," he was quoted as telling the paper. "We will be making decisions this year, so we have a number of weeks in which to do that."

The company is facing a drop in work once work on the two Queen Elizabeth class aircraft carriers are completed.

The paper said industry insiders believe BAE's base at Portsmouth is most at risk, with an estimated loss of 1,500 jobs. It said the Royal Navy's base at Portsmouth, where BAE also does repairs, is not at risk.

The news comes just weeks after talks between BAE and EADS on the world's largest defense and aviation merger collapsed.

"We continue to work closely with the Ministry of Defence to explore all possible options to determine how best to sustain the capability to deliver complex warships in the UK in the future," a spokeswoman for BAE told Reuters.

"This work is ongoing and we are committed to keeping our employees and trade unions informed as it progresses."

(AP) ? An Austrian photo gallery says a camera used by a photographer who documented the life of artist Pablo Picasso has sold for a world record price of ?1.68 million ($2.19 million).

The Westlicht gallery says the Leica m3d belonged to David Douglas Duncan. The 96-year-old former photographer for LIFE magazine was a close friend of Picasso and published hundreds of exclusive photos of him.

Manufactured in 1955, the camera is one of four ever made, and the price is a world record for a commercially produced camera.

In a statement Monday, Westlicht says the second-highest price in the Saturday's sale was for a gold-plated Leica made in 1929, which sold for ?1.02 million ($1.3 million).

But the latest ACDSee Pro 6 offers a lot for pro and serious amateur digital photographers, including integrated maps that work with geo-tagging, local adjustment brushes, and support for 64-bit CPUs for faster performance. And it is a responsive, enjoyable, and powerful pro photo tool that's less expensive than its nearest competitor, Lightroom. Despite all this, ACDSee Pro simply can't keep up with advanced features that media software giant Adobe includes in its digital photo workflow application.

Getting Started
You can download a free, fully functional 30-day trial of ACDSee Pro 6 to see whether it's your cup of photo-editing tea. It's Windows-only (sorry, Mac users), working from XP SP3 to Windows 8. Once you download its small installer, which handles the actual large download. The program size showed up in Control Panel as 177MB, compared with Lightroom's 835MB, so it will put less of a dent in your disk space. When you first run the app, a Quick Start Guide appears over the interface, offering to take you through a tour of its modes and tasks. This is a great help, considering the extensive number of modes, features, and tools in the program.

Like Lightroom, underneath ACDSee builds a database, or catalog to save all your image file preferences and edits. This means the originals, or negatives, are left untouched, so you can always revert to the photo's original state; you can save files containing your edits with the Export command.

Both editors also offer plug-ins, but there's a wider range of offerings for Lightroom?in fact, Adobe maintains an online plug-in-sharing section on its site for this. One important set of plug-ins that you can use in Lightroom, Photoshop, and Aperture, and Corel PaintShop Pro are those from Nik Software, which do things like precise sharpening and color effects and are a standard among pro photo editors.

Interface
ACDSee's interface always feels fast and fluid. Everything just works the way you expect it to, making switching between different activities intuitive. I had no trouble getting back and forth between organizing, viewing, and editing; even large camera raw files displayed quickly. Like Lightroom, ACDSee uses a modular approach: All this means is that there are big buttons that set up the app for the different types of tasks involved in the photo workflow process?importing and organizing, adjusting, enhancing, and outputting. Since I last evaluated ACDSee Pro, the module selection has changed, with Manage, View, Develop, Edit, and Online the current choices. Previously Develop and Edit were combined within the Process mode.

I mostly like ACDSee's mode options, especially splitting the manage and view modes, though I think a more generic output mode that included Print, rather than just online, would be preferable. And Lightroom outdoes ACDSee in the modes department by letting the user choose which modes should be available; that way if you, for example, never print photos, you can remove the Print mode.

Aside from this mode lock-in, the application's interface is very flexible: You can undock any panel so that it floats freely on your desktop, customize toolbars, and view in full screen.? It also makes extensive use of keyboard shortcuts for quick operation. You can change the photo background shade from the default dark gray, but not the overall interface from that same shade. Reset icons are everywhere, so if you goof, it's a cinch to get back.

On patrol with a shark ranger in Indonesia

Conservation International works with Indonesian children to help them learn how to protect the most diverse underwater region in the world. ?NBC News' Richard Engel reports.

RAJA AMPAT, Indonesia ? The remote Indonesian archipelago of Raja Ampat is home to an underwater treasure trove of coral reefs and tremendous biodiversity, miles away from polluted urban centers and human encroachment.

The faraway islands in Western Papua, regarded by many marine experts as having the potential to help restore the world's ailing coral reefs, are vulnerable to the unchecked exploitation of a lucrative treasure that is rapidly disappearing from Indonesia's waters: sharks.

China's growing appetite for the de rigueur shark fin soup has attracted fishermen from elsewhere in Indonesia and Southeast Asia to the waters around Raja Ampat's 1,500 islands.

Alarmed, conservationists and local villagers worked together to create the Misool Eco Resort and Conservation Center in 2005, establishing a 165-square-mile "No-Take Zone" that banned fishing.

When a neighboring village requested to take part, the area was expanded to 472 square miles, roughly the size of the city of Los Angeles.

The Misool team also recruited a group of rangers to help patrol the waters for illegal fishermen. Earlier this year, NBC News had an opportunity to go on patrol with Abdul Razak Tamher, 31, one of the first rangers.

Q: Before 2005, what were shark and fish stocks like in this area of Raja Ampat?

A: Before 2005, one of the main occupations of the people of my village was fishing. That's what we did every day and one of the big things fished were sharks. By the 2000s there were very few sharks left in the area, but in the 1980s and 90s when I was fishing there were lots of sharks. A lot of people used dynamite and potassium cyanide for fishing.

Q: So did villagers in Misool know they had to change the way things were done?

A: At that time, people here really didn't think much about shark or marine conservation. We didn't know shark fishing was illegal (prior to the formation of the No-Take Zone in 2005, the local governor had actually signed a law against shark fishing) because nobody from the government came out here to tell or educate us that it was illegal and bad for the ecology to fish sharks.

It was really through the efforts of the resort to educate the village about the importance of sharks and protecting the marine environment that we saw the importance of it and began to appreciate the natural beauty ourselves. Now if people from my village hear of a shark fishing boat coming into this area, they get really upset.

NBC News' Richard Engel talks to a Conservation International scientist as he identifies a new species of fish.

Q: Is conservation a completely foreign idea here? Isn't there a long tradition of seasonal fishing and spiritual beliefs around protecting certain animals?

A:?We've embraced principles of conservation since the beginning of our culture. They were simple ideas, but they still worked for us. For example, we would harvest clams from the ocean for six months, then depending on the ocean conditions, we would close that area for sometimes up to a year before harvesting again.

Many of the original families in this area are forbidden to eat different sea creatures like sharks or turtles or other kinds of fish. In each case, there is a reason why each family respects and protects a certain animal. It could be that a family member or fisherman generations ago was rescued by that species or guided to land at a time of need. Many still believe that if someone in the family breaks this taboo, they will get sick or something bad will happen.

Q:?In 2006, the rangers were formed with just five of you and a few of you were actually former shark fishermen. What made you make such a dramatic change in your life?

?A:?I personally wasn't involved in shark fishing, but other original rangers that were here in the beginning and their village elders were shark fishermen. Even though they were shark fishermen and lived off the harvest of the ocean, they realized that they needed to preserve this area and the marine life for future generations to come.

Many of us felt ? and still feel today ? that if we told our children or grandchildren that there were lots of fish and sharks in the sea around these islands and they went there and saw none they would think that we were liars and we just couldn't allow that to happen.

Q:?What was it like in the early days with the rangers?

A:?The rangers weren't really effective until 2009 because at that time there was only one speed boat that was always busy getting lumber for the construction of the resort. So we would only go out if we saw an illegal boat go past the resort. From 2006-2009, we went out almost every day. In the months of June and July, the area was choked with shark finning boats from as far away as Java that cast long lines with sometimes 1,000 or 2,000 hooks to catch sharks.

To expel the foreign boats, it wasn't a problem. We would just go up to the boats and tell them leave and they would go. Local fishermen were tougher. Most of the problems had to do with local fishermen not agreeing with the contract we signed with Misool Eco Reserve to create the no-take zones or claiming they were not around when the contract had been reached. They would also say we have it easy since we work as rangers and make a lot of money, so we don't need to fish like they did.

Q:?How soon after the reserve formed did you start to see results from the sanctuary?

A:?After two or three years, I started to see a lot of sharks in the lagoons and my friends who went diving began to see more fish. There were just some researchers here in Misool who were shocked by the amount of fish who were in the protected areas. The results have just been amazing.

Q:?How have the villages in the area adapted to the sanctuary?

A:?In the beginning, there were a lot of problems with the villagers not understanding the rangers' mission. The most important thing we did to get people behind us was to use Adat, or traditional Papuan village law. This was done by developing a close relationship with the ancestral village head, as he holds the power of the village and so people will listen to what he says. If we didn't have the village head, then it would have been difficult to enforce the rules of the sanctuary.

Q:?What's next for the rangers in the coming years?

A:?We all hope the ranger patrol can continue forever and that we have the resources to keep recruiting young people from the villages to the patrol. We now have three ranger stations built and we hope to have three rangers in every station with small, fuel-efficient boats that can be used to spot illegal fishermen and intercept them until support can show up.

The other big problem we'd like to fix is communication. Radio communication in this region of Raja Ampat is difficult because all the radios we have now are line-of-sight and the islands interfere with signal within short distances. The plan is to build a main radio/repeater station that will cover the entire area so that there is clear contact throughout the sanctuary.

Ducks rebound with 48-24 win over Beavers

CORVALLIS, Ore. (AP) ? Kenjon Barner ran for 198 yards and two touchdowns despite leaving the game for a time with an injury and No. 5 Oregon defeated No. 16 Oregon State 48-24 in the Civil War on Saturday, keeping alive the Ducks' hopes for a spot in the Pac-12 title game and even an outside chance at the national championship.

De'Anthony Thomas, who helped picked up the slack while Barner was on the sidelines, ran for 122 yards and three scores for the Ducks (11-1, 8-1).

After Oregon's undefeated season was thwarted by a 17-14 overtime loss to Stanford last weekend, the Ducks had to wait for UCLA's game against the Cardinal later Saturday to see who would be headed to the conference championship game. Both Oregon and Stanford started the day with one conference loss in the league's northern division.

It was Oregon's fifth straight victory in the 116-game rivalry series with the Beavers.

While the Civil War is normally the season finale for both teams, Oregon State (8-3, 6-3) will host Nicholls State next Saturday in a matchup that was supposed to open the season but was put off when Hurricane Isaac bore down on the Colonels' Thibodaux, La., campus.

The Beavers will have to wait to find out where they're headed for a bowl game, but already their season can be counted a success after they went just 3-9 last year.

Barner appeared to hurt either his abdomen or ribs late in the first half and headed to the locker room. He returned after the break, but much of the work went to Thomas until he returned on a scoring drive that made it 41-17 early in the fourth quarter.

Oregon redshirt freshman Marcus Mariota threw for 140 yards and a score, and also ran for 85 yards and a touchdown.

His Oregon State counterpart, Sean Mannion, threw for 311 yards and a touchdown but was intercepted four times. Storm Woods rushed for 70 yards and two scores.

Mannion started the first four games of the season, throwing seven touchdowns and averaging 339 yards, but injured his left knee and required surgery. Vaz, who hadn't started since high school, took over and helped the Beavers to win in the next two games, and later became the team's starter.

But Vaz sprained his left ankle in the final moments of a loss to Stanford two weeks ago, and sat out last Saturday during Oregon State's 64-14 victory at home over California. Mannion got the nod for the Civil War.

A 47,249 fans attended the game, setting Reser Stadium record.

Oregon put the Stanford loss behind them by striking quickly on their first possession with Mariota's 42-yard keeper. The touchdown drive took just 1:46, but the Ducks' 2-point try to cap it off failed.

The Beavers took a 7-6 lead on Woods' 7-yard touchdown run, but the Ducks answered on the next series with Thomas' 2-yard TD dash. Barner added a 1-yard scoring run before he was hurt.

Stanford held Barner to 66 yards the week before, but he had 141 yards before halftime against the Beavers. With his first 15 yards rushing Saturday, he moved past Derek Loville (1986-89) for second on Oregon's career rushing list.

Trevor Romaine kicked a 36-yard field goal to narrow it to 20-10 at halftime and the Beavers pulled closer with Woods' 2-yard scoring run on their first series of the second half.

It was all Ducks the rest of the way. Thomas scored on a 6-yard run to extend Oregon's lead to 27-17, before the Ducks capitalized on a Beaver fumble that led to Thomas' 29-yard touchdown run. Barner returned with his 1-yard run and Mariota found B.J. Kelley with a 2-yeard scoring pass.

Mannion hit Micah Hatfield with a 6-yard touchdown pass with 20 seconds left for the final margin.

The Ducks hold a 60-46-10 advantage in the Civil War which dates back to 1894 and is the seventh-most contested rivalry in the nation.

It was the fourth time that both teams were ranked for the Civil War. The last was in 2009, when Oregon was No. 7 and Oregon State was No. 13. That game was dubbed the "War of the Roses" because the winner was guaranteed a Rose Bowl berth. Oregon won 37-33.

Linux Foundation vet explains setbacks in getting a Secure Boot key for Windows 8 PCs

Linux fans wondering why they still don't have a friendly UEFI Secure Boot option for Windows 8 PCs won't get a solution in hand this week, but they'll at least get an explanation. The Linux Foundation's primary backer for the alternative OS efforts, Parallels' server CTO James Bottomley, has revealed that Microsoft's requirements for signed, Secure Boot-ready code are tough if developers aren't entirely onboard its train of thought. The Redmond crew demands a paper contract signature (remember those?), agreements on work beyond the relevant software and a packaging process that complicates attempts to use open-source tools. Bottomley has already overcome most of these challenges, although he's still waiting for a Linux Foundation-specific key that should theoretically clear a major hurdle. Whether or not that leads to a remedy in days or weeks is up to Microsoft; in the meantime, we'll take comfort in knowing that a signature is so far a convenience for booting into Linux, rather than a necessity.

The Pareto Analysis provides that 80 percent of outcomes can be linked to 20 percent of causes. This means that 80 percent of your revenues may often be generated by 20 percent of your products or services, and that 20 percent of your customer base may command 80 percent of your business resources. The question is: Are these the same products and/or services, and/or customers? To know which is which, who is who, and what this all means for your business, you will first need an accounting system. In this example, with clear information you can focus your time and your resources to achieve the best product mix while most effectively deploying your staff.

2. Take advantage of trend analysis

Numerous macro or micro-economic factors affect businesses, such as a change in the price of raw materials or a shift in buying habits. Whatever your business may be, trends need to be analyzed in order to make the necessary adjustments to either minimize a potentially negative impact, or take advantage of a potential gain. For example, in a seasonal business, perhaps it makes sense to accumulate inventory when prices are low during the off-season to serve your clients during the busy season. Accounting allows your small business to find profitable trends and capitalize on them.

The cleanup efforts at Fukushima's nuclear facility are been peppered with robotics: packbots, a refitted TALON, even a UAV - but Toshiba figures it could use at least one more. The firm's contribution is known only as the Quadruped walking robot, and it looks somewhat like Boston Dynamics' AlphaDog. Shuffling along on four double-jointed legs, the Quadruped can traverse uneven terrain and stairs at 0.6 mph, and is capable of exploring uninhabitable and irradiated areas for two hours before requiring a recharge. A second robot rides on the Quadruped's back, and can explore tight spaces for up to an hour when tethered to the its mentor. Toshiba is outfitting the duo with cameras and radiation dosimeters, and hopes to use them to help officials survey the damage in the plant's deadlier corners. Tax increases could factor in MLB negotiations

Team executives and agents wandered into the Agave Sunset lounge at the resort where the general managers' meetings were held in Indian Wells, Calif. Four of the six flat-screen televisions were showing election coverage, with the other two turned to sports.

President Barack Obama's victory over Mitt Romney was of as much interest to baseball's money men as the game scores, given the millions of dollars routinely guaranteed in player contracts these days.

As free agents negotiate deals this offseason, tax policy is an area that comes up along with the usual issues. Some players are wrangling for as much money as they can get before the end of the year to avoid a take hike in 2013.

"Front-loading would make sense if at all possible as tax rates will definitely go up on January 1st on all high-income taxpayers," agent Greg Genske said in an email. "The only question is HOW MUCH will the rates increase????"

This much is known for now: Starting Jan. 1, there is an additional 0.9 percent Medicare tax on wages above $200,000 for individuals and $250,000 for married couples filing jointly under the federal Affordable Care Act, a rise to 2.35 percent.

In addition, the Bush tax cuts are scheduled to expire at the end of the year, which could raise the highest marginal federal tax rate from 35 percent to 39.6 percent - although a deal between Obama and Congress could change that.

Oakland Athletics general manager Billy Beane figures agents will be on top of the changes - but the results of negotiations about the so-called fiscal cliff are unpredictable.

"I think if you're hopping around the potential of tax reform, you're probably chasing your tail," Beane said. "If they can predict when something's going to happen, then they're much further ahead than the lawmakers."

With baseball contracts worth as much as $275 million (Alex Rodriguez) and the major league minimum $480,000, tax policy affects every player who spends most of the season in the big leagues.

All-Star shortstop Jose Reyes, who has a $10 million salary next year, was traded from the Miami Marlins to the Toronto Blue Jays. While Florida has no state income tax, Reyes remains a New York resident from his days with the Mets and had high taxes to begin with. Ontario's provincial tax rises to 11.16 percent - on top of a Canadian federal level as high as 29 percent.

Among states with big league teams, income tax rates go as high as 10.3 percent in California and 8.82 percent in New York. At the other end, Florida, Texas and Washington have no state income tax. The top rate in the District of Columbia is 8.95 percent.

"I like ours; we're a no-tax state," Seattle Mariners general manager Jack Zdurienck said. "When we sit down with players, that's a huge benefit. I think any player out there that has an opportunity to play in a no-tax state gets benefits, enormous benefits. We hope that weighs in our favor."

According to an analysis done by a tax lawyer on the staff of agent Scott Boras, a player with a $10 million salary and average deductions who plays in Florida and is a resident of that state will see his taxes rise from $3.45 million this year to $4.09 million next year under current law. If traded to the Blue Jays, that player's 2013 tax would rise to $4.27 million. And if dealt to a California team, the tax would go up to $4.4 million.

By moving money from salary into signing bonuses, players can sometimes lower their state tax bills. Shifting money into December this year could reduce federal taxes.

"Tax measures are going to be discussed, but change most likely carries compromise on both sides," Boras said. "One thing is clear based on the nation's ballot totals: Many Americans are split on this subject."

In the end, most free agents choose teams based on where they want to play, not on lowering the tax cut on their income.

"It's a factor, maybe even a small factor," agent Craig Landis said. "If there's 50 variables, you can now make it a 51st. It's not usually going to be the drive, but it's something to consider."

And for teams, only the big spenders need worry.

Beane's Athletics, for instance, had the lowest payroll in the majors last season.

"It's probably not a situation I'll have to face in Oakland too much," he said.
